The Disaster Risk Management South Africa platform ("DRMSA", "Platform", or "Service") is developed and operated by Diswayne Tech Systems Pty Ltd ("we", "us", or "our"), a company registered in the Republic of South Africa. DRMSA is designed to support municipal disaster risk management officials, NGOs, and government bodies in fulfilling their obligations under the Disaster Management Act 57 of 2002 and related national and provincial frameworks.
By registering for an account you confirm that you have read, understood, and agree to be bound by these Terms of Service and Privacy Policy. If you do not agree, you may not use the Platform.
Access to DRMSA is restricted to:

All accounts are subject to approval by a designated Municipal Disaster Officer or Platform administrator before access is granted. You agree to:

You agree to use the Platform solely for lawful disaster risk management purposes. You must not:
You and your municipality retain full ownership of all data you upload or generate on the Platform ("Municipal Data"). By submitting data you grant Diswayne Tech Systems Pty Ltd a limited, non-exclusive, royalty-free licence to host, store, process, and display your Municipal Data solely for the purpose of providing the Service.
We will never sell Municipal Data to third parties or use it for commercial profiling.
Diswayne Tech Systems Pty Ltd is a Responsible Party as defined under the Protection of Personal Information Act 4 of 2013 (POPIA). We process personal information lawfully, minimally, and for specific purposes related to disaster risk management.

Data hosting: All data is stored on infrastructure provided by Supabase, hosted in the European Union (EU). Cross-border transfers are conducted under appropriate safeguards consistent with POPIA Section 72 requirements.
Your rights under POPIA: You have the right to access, correct, or request deletion of your personal information. Submit requests to legal@drmsaplatform.co.za. We will respond within 30 days.
Retention: Account data is retained for the duration of your active account and for 5 years thereafter in accordance with municipal records obligations, unless a shorter period is required by law.
We implement industry-standard technical and organisational measures including encrypted data in transit (TLS), encryption at rest, row-level security policies, and audit logging. No system is completely secure — you are responsible for maintaining the confidentiality of your own credentials.
We aim to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from temporary unavailability of the Platform.
All software, design, documentation, and other materials comprising the DRMSA Platform are the intellectual property of Diswayne Tech Systems Pty Ltd or its licensors, protected under South African copyright law. These Terms do not transfer any Platform IP to you.
The Platform is provided "as is" and "as available" without warranties of any kind, including fitness for a particular purpose or compliance with any specific legislative reporting requirement. DRMSA is a decision-support tool — final responsibility for disaster risk decisions remains with the relevant municipality and its appointed officials.
To the maximum extent permitted by South African law, Diswayne Tech Systems Pty Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total aggregate liability shall not exceed the amount paid (if any) by your organisation for the Service in the 12 months preceding the claim.
Either party may terminate at any time. We may suspend or terminate your access immediately if you have breached these Terms or if required to do so by law. Upon termination your right to access the Platform ceases immediately; data is retained as specified in Section 6.
We may update these Terms from time to time. Material changes will be notified by email and the effective date updated. Continued use after updated Terms take effect constitutes acceptance.
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of South African courts. We encourage informal resolution first — contact legal@drmsaplatform.co.za before initiating formal proceedings.
